Terms of Service

1. Acceptance of Terms

By accessing or using the BaseGold website (basegold.io), The Mine application, or any related smart contracts (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you:

• Are at least 18 years of age
• Have the legal capacity to enter into these Terms
• Are not prohibited from using cryptocurrency services in your jurisdiction
• Will comply with all applicable laws and regulations

3. Description of Services

BaseGold provides:

• BG Token: A deflationary ERC-20 token on Base network with a fixed supply of 10,000 tokens
• Gold Mine NFTs: ERC-721 tokens that provide access to The Mine ecosystem
• The Mine: A gaming platform where NFT holders can earn in-game rewards
• Gold Vein: A referral rewards system
• Instant Burn: A mechanism to burn BG tokens
• DAO Governance: Community voting for token holders

4. Wallet and Security

To use our Services, you must connect a compatible cryptocurrency wallet. You are solely responsible for:

• Maintaining the security of your wallet and private keys
• All transactions made from your wallet
• Any losses resulting from compromised credentials

We will never ask for your private keys or seed phrase. Anyone who does is attempting to scam you.

5. Risk Disclosure

By using our Services, you acknowledge that:

• Cryptocurrency prices are highly volatile and can result in significant losses
• Smart contracts may contain bugs or vulnerabilities despite auditing efforts
• Blockchain transactions are irreversible once confirmed
• Regulatory changes may affect the legality or value of digital assets
• The value of BG tokens and Gold Mine NFTs may go to zero
• Past performance does not guarantee future results
• In-game rewards (gold, scores) have no monetary value outside The Mine

6. Prohibited Activities

You agree not to:

• Use our Services for any illegal purpose
• Attempt to exploit, hack, or manipulate our smart contracts
• Use bots or automated tools to gain unfair advantages in The Mine
• Manipulate game scores or leaderboards through fraudulent means
• Engage in market manipulation or wash trading
• Harass, abuse, or harm other users
• Impersonate BaseGold team members or other users
• Distribute malware or malicious code
• Circumvent any security measures

7. In-Game Economy

The Mine features an in-game economy with virtual gold, upgrades, and scores:

• In-game gold and scores have no real-world monetary value
• Game progress is stored on our servers and may be reset between seasons
• We reserve the right to modify game mechanics, rewards, and balancing
• Leaderboard prizes (if any) are distributed at our discretion
• Cheating or exploitation will result in disqualification and potential bans

8. NFT Ownership

When you purchase a Gold Mine NFT:

• You own the NFT as recorded on the blockchain
• Ownership can be transferred or sold on secondary markets
• Game progress is tied to the NFT, not your wallet address
• We grant you a license to use associated artwork for personal, non-commercial purposes

9. Intellectual Property

All content, trademarks, logos, and intellectual property related to BaseGold are owned by us or our licensors. You may not use our branding without explicit permission, except for:

• Sharing links to our website and services
• Creating fan content that clearly indicates it's unofficial
• Editorial or news coverage

10. Third-Party Services

Our Services integrate with third-party providers including wallet providers, on-ramp services, DEXs, and RPC providers. We are not responsible for the availability, accuracy, or conduct of these third-party services.

11. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We are not financial advisors. Nothing in our Services constitutes financial, investment, legal, or tax advice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASEGOLD AND ITS TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR DIGITAL ASSETS, ARISING FROM YOUR USE OF OUR SERVICES.

13. Indemnification

You agree to indemnify and hold harmless BaseGold, its team members, and affiliates from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

15. Termination

We may suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, you retain ownership of any tokens or NFTs in your wallet.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation or, if necessary, binding arbitration.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
